Scotts To Pay $1.2 Million Over Unregistered Pesticides

Scotts Co. has reached a $1.2 million settlement with the New York State Department of Environmental Conservation over the sale and distribution of unregistered pesticides in the state.

Under a consent order signed by the department and Scotts, the Marysville company will pay a civil penalty of $300,000, and contribute $900,000 to a fund to collect and dispose of unregistered or unwanted pesticide products.

A separate $300,000 penalty was suspended, provided the company complies with the provisions of the consent order.

The unregistered pesticides allegedly sold or distributed by the company were RosePride Systematic Triple Action Spray and a new formulation of Grubex, an insecticide. The products were allegedly sold or distributed between December 1999 and April 2000 before the state's regulators had finished reviewing their applications.

RosePride, also an insecticide, has since been registered for sale in New York state, but the application for the new formulation of Grubex was denied over concerns its active ingredient, halofenizide, could contaminate groundwater.

As part of the settlement agreement, Scotts admits to having made sales of Grubex in violation of pesticide laws, according to the state.
